Freight brakeman was sent out to flag but wasnot equipped with torpedoes or fusees as the rules flagged passenger train on engineers side Imt engineerfailed to see him and he had no torpedo down; engine wasusing steam when collision occurred, having no warningwhatever; flagman was not out proper distance; engineeron passenger train also was not maintaining sharp look-out. Engineer on freight that had cut off should havestopped passenger train or given warning, as there was nouse of passenger train going to point of accident, bothtracks being badly blocked and they could not get byuntil cleared.
