(Keeler vs. Green, 149 Pacific Reporter, 286.) The buyer alleged that April 1, 1913, the defendant sold him 145 bushels of wheat for spring seeding, warranting the wheat to be spring Fife wheat. After preparing the ground, he properly sowed the wheat upon ninety- seven acres, and used care to produce a crop. The wheat, however, did not produce a crop because it was fall wheat, which the defendant knew at the time of the sale, or could, with rea- sonable diligence, have ascertained. The court said: "The allegations are clearly sufficient to charge a warranty of character and quality by the seller. It was the seller's duty to know that the goods delivered were of that charac- ter and quality, and, if they were not, the responsibility is his, in the absence of an acceptance with knowledge by the buyer.'' It is to be noted that this sale was not made under any disclaimer of war- ranty on the part of the seller, within the well settled rule of law that a seller of seed may avoid liability by inserting in the contract a disclaimer of warranty. • Plea
