If it chose toaccept, it must deposit within sixty days in the ChemicalNational Bank of New York City the amount stipulated byMr. Rogers, whereupon it would be given full opinion was rendered by Judge McCrary, who sat forJudge Hallett. The Rio Grande offered to give bonds forany amount in order to get possession of the line, which theydesired to extend to Leadville without delay. But McCrarydeclared that nothing could be done until Rogers gave hisreport, and so matters remained for several weeks. Impatient of further delay, Denver & Rio Grande attor-neys appeared before the United States Supreme Court on. The Grand Canon War Concluded 201 January 5th, and succeeded in getting an early day ap-pointed for hearing an application for a writ of mandamus, which application had already been made. This writ, ifgranted by the higher court, would compel Judge Hallettto execute the original Supreme Court decree of April, 1879,without requiring the D. & R. G. people to make payment ofany kind for the work done by the Santa Fe, and withoutany conditions whatever. It was pleaded that the CircuitCourt had not placed the Denver & Rio Grande Companyin possession of its prior right of way as ordered; but onFebruary 2nd the Supreme Court12 sustained Halletts in-terpretation of their decision and denied the petition. Herewas a Santa Fe victory, but while the highest court in theland deliberated, a small group of financiers met and bymutual concessions compromised the difficulties and broughtpeace to the warring companies.
