We think both parties should have accepted that judgment aa final. We agree with the (5ourt. below that the defendants used exprt-MionB which .were of an injurioua tendency, but we think the plaintitt" should have been satisfted with the judgipent by which he was relieved from costs. We confirm the judgment, but each party will have to pay his own costs in this Court as well as in the Court below.
