On August 16, 1864, assumed command of the CentralGuard-House, then used as a military prison, and re-mained on this duty until July 12, 1865, when, the warhaving terminated, the prison was turned over to the46. civil authorities July 12 to October 4, 1865 ; he was misick-leave to December 7, 1865, and then on duty atCamp Carrington, Indianapolis, Indiana, commandingdetachment of two companies of the Twenty-secondRegiment, Veteran Reserve Corps, and engaged in mus-tering out volunteer troops. Lieutenant Rutherford received contused wound ofright knee-joint at Rappahannock Station, Virginia, andcontracted rheumatism in the field, causing great andcontinuous suffering, and resulting in the distortion ofboth feet. He took part in the Shenandoah Valley campaignof 1862, and General Popes campaign from CulpeperCourt-House to Washington, and was present at Win-chester, Rappahannock Station, Beverlys Ford, SulphurSprings, second Bull Run, and Fort Stevens. Captain Rutherford was mustered out of the volun-teer service as brevet lieutenant-colonel April 30, 1867,and was appointed second lieutenant of the Forty-fifthInfantry, to date
