Thisfather married Frances, daughter of Judge Ephraim Kirby, ofthat place—the author of Kirbys Connecticut Smith was appointed a major of the United Statesarmy in the early part of the war of 1812. He was afterwardspromoted to Colonel, and served during the war on the Canadafrontier. After the war he was appointed United States Judgefor the district of Florida, and removed, with his family, to , where he died about the year 1841. He had twosons; the eldest, Ephraim Kirby, graduated at West Point,and was a captain in the regular army during the Mexican,war. He was killed at Molino del Key.
