That the above areaâthat is to say, one-Pfth of the land âhas for the last two years of the term been planted with timber, and that the latter has been regularly and well culti- vated and protected from the time of planting : provided that in casee where the land eiitered is less in extent than one quar- ter section or one hundred and sixty acres, then the respective areas required to be broken and planted under this and the two next preceding sub-sections shall be proportionately les? in ex- tent, If at any time within the period of six years as above, the claimant fails to do the breaking up or planting, or either, as required by this Act or any part thereof, or fails to cultivate; protect and keep in good condition such ti nber, then and upon such event the land entered shall be liable to forfeiture in the discretion of the Minister of the Interior, and may be dealt with in the same manner as Homesteads which may have been cancelled for no:, compliance with the law. ^* Provided that no person who may have obtained pre-emption entry of a quarter section of land in addition to his Homestead under the rvovisions o: <b-section one of section thirty- three of the said " Dominion LT,nds Acts," as amended by the Act of 1874 :ind by this Act, shall have the right to enter a third quart<jr section as a tree planting claim ; but such person, if residcucupon his Homestead, may have the option of chang- ing the pre-e
