The fourth count,inducing witness to withold true testimony from theFrawley committee, rested chiefly on two Morgenthau testified that he had contributed$1,000 to the Governor without specifying its particularpurpose, and that Sulzer had called him on the tele-phone and asked him to be as easy as he could on himif called as a witness. Duncan W. Peck testified thatSulzer had told him to deny his contribution, and thatwhen he replied: But I suppose I will be underoath, the Governor answered: Thats nothing, forget.
