That the present apparent conflict of jurisdiction between the Dominion andProvincial authorities should be so arranged that those engaging in the private cultiva-tion of oysters will have security in the titles to leases and be afforded adequate protec-tion for the investment of capital, and to this end we recoromend that a conference beheld at an early date between the Dominion Government and representatives of theGovernments of the Maritime Provinces Oyster ;. th Toiigs CANADIAN OYSTER INDUSTRY 133 before the Supreme Court for adjudication. It centres about the inter-pretation of section 91 of the British North America Act. This sectionof the Act says that the Dominion Parliament has exclusive legislativeauthority in all matters respecting Sea Coast and Inland 92 of the Act, however, gives the provinces exclusive power toissue licenses to provide funds for provincial revenue. It would appearfrom this that the fisheries, and the oyster industry along with them,may be subjected to double taxation at the hands of the Dominion andProvincial Governments. The following questions relating to fisheries were submitted to theJudicial Committe of the Imperial Privy Council in the Fisheries Referenceof 1898: (5) Had the riparian proprietors before confederation an ex-clusive right of fishing in non-navigable lakes, rivers, streams, andwaters, the beds of which had been granted
