The section of the law preventing Negroes from being witnesses or testifying in thecourts of justice was known as Section 394—Witness—Persons incompetent. Section 394of the Civil Practice Act provides: No Indian, or Negro, or persons having one-halfor more Indian blood and Negroes or persons having one-half or more of Negro blood,shall be allowed to testify as a witness in action in which a white person is a party.
