Hall, appellant. The appellant, afree white citizen of this State, was convicted of murder upon the testimony of a Chinesewitness, the point involved in the case is the admissibility of such evidence. The case wastried before Chief Justice J. Murry and J. Heydenfeldt. The following is a part of thedecision: No Black or Mulatto person or Indian shall be allowed to give evidence infavor of or against a white man. Held, that the word Indian, Negro, Black, and whiteare generic terms designating races. That therefore Chinese and all other people not whiteare included in the prohibition from being witnesses.
