At his secondelection to the common pleasbench he was the candidatenot only of Tammany hall,but of the Mozart hall wingof the democrats, and of theUnited republicans, and wasalone in the field, and placed onthe bench by an immense first term on the supreme court bench expiredin 1877, and he was again the candidate for the re-publicans and both branches of the democracy. In1878 he was assigned to be a general term judge,and up to the time of his death was a member of thegeneral term of the first department of the supremecourt, and had he lived but a few months longer,would have retired, having reached the constitu-tional age of seventy, and would also have completedthe last term of fourteen years, for which he waselected to the supreme court.
