It is apparent, too, that the seller exorcised his judgment in this particular by changing from one species to another and shipping from a different source of supply, to wit, cold storage from Omaha, instead of Chi- ; It is to be specially noted that the court did not hold that there would have been an implied warranty of bulbs, had they been of the variety pro- vided for in the orders. It is to be in- ferred from the opinion that the pro- vision in the orders that the seller did not guarantee the character of the goods, flowering results, etc., would have been sufficient to protect the seller, had bulbs of the kind provided for by the orders been shipped. The decision rests on the fact that the orig- inal contract was not executed, the buyer trusting to the seller's judgment to substitute proper bulbs for the vari- ety previously agreed upon. S.
