De Temple, of the Waltham team, won the affair, but owing to thestarters error it was ruled by the officials thatDe Temple and Thomas should come togeth-er at some further day set by the promoters. Seyfang & Prentiss, the Bison people,agreed to the decision, but the representativesof the Waltham Company refused to entertainthe proposition, ard went so far as to securean injunction on the promoters of the con-. The injunciion, however, was quicklyvacated by Judge Childs when brought totrial, and Saturday last was then fixed as thedate for the final trial, being the first suitableday. Both firms were notified to prepare foithe event, but the Waltham Company sent aletter from their attorney refusing to recog-nize the race on various grounds, and inwhich they maintained that the trophy wastheir rightful property. Thomas, of the Bison firm, was on hand,and in accordance with all the rules andthe proper officials, started alone andpassed De Temples mark by 118 was officially declared the winner of thetrophy.
