He helped capture PortPulaski January, 1861, and enlistedas a private in tlie first company for the war, 8th Geor-gia infantry, and served to the end. After fighting inthe first Bull Run battle, he became captain, major,lieutenant-colonel, and colonel of cavalry in theWest, commanding a brigade the last year. After thewar Col. Avery, penniless, made his first money on across-tie contract, and removing to Dalton, Ga,, in1866, began successful law practice. He wrote aDigest of the Georgia Supreme Court Reportsin 1866, subscribed for by the legislature. He wentin 1867 to the first post-war state democratic conven-tion, and wrote the platform. He moved to Atlantain 1869 ; was chief editor of the Atlanta Constitu-tion for years ; was delegate-at-large to the presi-dential democratic convention in 1872, and on the. ^rrfiAirvvoj platform committee ; member of the state democraticexecutive committee, and its secretary the same year;was secretary Georgia executive department, 1877-83,under governors Colquitt, Boynton, and AlexanderH. Stephens; published a History of Georgia in1881 ; bought, in 1875, the Atlanta Herald, sell-ing on account of ill health in 1876; started and ranthe Evening Capitol for one year, carrying pro-hibition in Atlanta the only time, then selling out;was in 1886 strongly urged for U.
