Judge Clement refused to dismiss, andthe jury rendered a verdict for the boys father forthe full amount sued for, with interest. The com-pany appealed the case, and in May last the gen-eral term affirmed the judgment. Judge VanWyck, writing the opinion, held that the jury wasjustified in holding that the motorman was toblame in not discovering the approach of the child.
