BLACKSTOITK. 107 _j A W.—In an action in the Court of Common Pleas (which is/{be original and proper court for prosecuting civU suits), thegeneral and orderly parts are: the original writ, the process,the pleading, the issue or demurrer, the trial, the judgmentand its incidents, the proceedings in the nature of appeals,^and the execution. ^ i The original writ, or prcecipe, is the beginning orfoundation of a suit, and is directed to the defendant by theofficer of the court, commanding him to do some certainthing, as to appear in court, or show cause to the contrary. The process is (or includes) th« means of compellingthe defendant to appear in court, viz.: either by summons,attachment, distringas, capias ad respondendum, and testatumcapias, alias, andp/uries writs, writ o{ exigi facias, proclama-tions and outlawiy, appearance and common bail, arrestand special bail.
