Birney, with the approval of ColonelDare, then suffering from a disability, from which he soonafterwards died, received authority from the Secretary of Warto organize the regiment for the first three years the co-operation of many of the officers and men whohad served with him in the three months service, began therecruiting of companies, and two days after the muster out ofhe thf months regiment.
