No indictmentdrawn by him was ever successfully attackedon demurrer. After the termination of theterm of Air. Nicoll, he was reappointed byColonel John R. Fellows, and on the death ofColonel Fellows the latter was succeeded byHon. William M. K. Olcott, and Mr. Battleresigned, although Mr. Olcott requested himto continue in office.
