The Supreme Court of the State of Minnesota, how-ever, has declared constitutional the law compelling theuse of the ■ vestibule for the protection of motormenduring the winter months. The test case was that ofSuperintendent Hoskins, of St. Paul, who was arrestedfor failing to comply with the requirements of this ordin-ance. The Twin City Rapid Transit Company carried thecase to the Supreme Court with the result The law was sustained at all points. The court holdsthat when running at a speed of eight or ten miles anhour, with the mercury below zero, the motormans posi-tion is not only one of discomfort, but of actual dangerto health and sometimes to life, not only to himself, butindirectly to the passengers in his charge. The corpora-tion held in its plea that the measure was class legislationand not an exercise of the police powers of the state. One of the vestibules which was built last winter bythe Twin City Company, is represented in the accom-panying engraving. NEGLIGENCE OF A CO-EMPLOYE. Suit was begun not long ago against the Metro-politan Street Railway Company, of Kansas City, Mo.,by Henry D. Ely, an employe, who sued for damages,alleging as the cause of his injury the negligence of afellow workman.
