Opinion by Phillips, Commissioner: Petitioner proposes to cross with its two main tracks, the tracks of therespondent companies upon and near Stewart avenue, in the city of Chi-cago. It alleges that objection to the proposed crossing is made by re-spondents, and asks that this Commission enter an order under the act of1889, prescribing the place where and the manner in which said crossingshall be made. Such formal matters are alleged in the petition as bringthe case within the statute. The first point made relates to the jurisdiction of the Commission, whichis questioned upon the ground that respondents did not, prior to the ex-liibiting of the petition, make specific objection to the crossing as nowproposed.
