Persons placed in any hospital for the insane, may be removed there-from, by parties who have become responsible for the payment of theirexpenses; provided, that such obligation was the result of their own free. Insane persons shall not be tried for any criminal act during theexistence of their insanity; and for settling this issue, one of the judgesof the court, by which the party is to be tried, shall appoint a commission,consisting of not less than three nor more than five persons, all of whomshall be physicians, and one, at least, if possible, an expert in insanity, whoshall examine the accused, hear the evidence that may be offered touchingthe case, and report their proceedings to the judge, with their opinionsrespecting his mental condition.
