The Senatorswere advised that the mere possession of the Senate Cham-ber gave them no rights that they could not as well exerciseelsewhere; and, having on the floor of the Senate declaredthemselves to be the lawful Senate of the State, they picked up. Till the settlement of the controversythe Democratic hold-overs were left in undisturbed possession,and the eleven Republican Senators, transacted business in alittle committee-room across the hall from the AssemblyChamber. Governor Werts felt that the honor and wisdom of his admin-istration were challenged by this condition of affairs that madethe orderly progress of legislation impossible, and he was anxiousto find some way of taking the matter into the courts. Hisplans to that end were handicapped by the refusal of the Re-publican Senators to aid him in making a case over which thecourts could have jurisdiction. Their contention was that theLegislature and the judiciary were co-ordinate branches of theState government, and that the courts could not, by any decisionthat they might render, make a Senate or unmake one.
