To all whom it may concern, know ye that we CalebSmith junior, Isaac Blydenburgh and Joshua Smith junior,all of Smithtown, County of Suffolk and State of NewYork, do enter into the following articles of agreement,and bind ourselves accordingly, viz.: W V S s t>. Whereas we do possess in fee simple cer-tain streams of water adjoining our respective farms we dofor the Benefit and accomodation of each other, and forthe purpose of improving the same, agree that foreverhereafter we will hold and improve the same in equajJoint tenancy, and copartnership. Article 2nd. We will build a dam acrost said stream ofwater at the most convenient place from the lands ofIsaac Blj^denburgh to the lands of Caleb Smith junior, thesaid dam to be so constructed as to raise ten feet head ofwater and of sufficient width on the top for an ox cart topass and repass. We will erect on the above said dam a sawmill and grist mill (the saw mill to be of the Bigness ofPaul Smiths saw mill) and to be furnished with all toolsand implements necessary for carrying on the sawing busi-ness.
