To charge a person with legal liability for injury to another arising from the presence of a poisonous plant growing on the former's premises, it must ap- pear that he was guilty of carelessness in permitting it to grow under such cir- cumstances that it was apt to cause injury to others rightfully on the prem- ises. This is the substance of the hold- ing of the New York Supreme court in a recent case. In this case the plain- tiff, while placing flowers on her hus- band's grave in the cemetery grounds of the defendant, was poisoned by poi- son ivy growing on the grave, and was denied recovery because it did not ap- pear that the cemetery association was chargeable with notice of the existence of the ivy on the grave, although a flo- rist testified that, judging from the growth, it had been on the grave about two months. The court said: "The defendant is not shown to liave violated the rule of reasonable care, which I think is all that the law im- posed upon it. The courts should be extremely cautious, it seems to me, not to lay down any new rule, or enlarge any old one, so as to extend the lia- bility of those who own or control land, for the presence of poisonous plants upon their property.
