While driving an automobile from an in-tersecting street east into Monticello Avenue the man whobrought suit was struck by a car moving south along suchthoroughfare. The lower court decided that the motor-man was bound by the provisions of the traffic act and wasin error in not giving right of way to the automobile. Inreversing this ruling the Supreme Court decided that thetraffic measure cannot be held as applicable to street rail-way lines. It is pointed out that elsewhere in the actdrivers of vehicles are directed as to the course to be takenin passing other vehicles, turning corners and, in certaincircumstances, veering from one part of the roadway to an-other-. The court said that it is evident that such provisionsin the act could not have contemplated street cars, specifical-ly excluding with such considerations electric railway lines. 96 ELECTRIC RAILWAY JOURNAL [Vol. XLIX, No. 2.
