In December ofthat year President Tyler sent to the Senate the nameof John C. Spencer, of New York, who was at that timeSecretary of War. Confirmation was refused, the WhigSenators voting against him on the purely politicalground that, while formerly a Whig, he had acceptedoffice under President Tyler, a Democrat. In January. 1844, the President sent to the Senate the name ofReuben H. Walworth, Chancellor of the State of NewYork, but it was pigeonholed and no action was takenupon it by the Senate for more than a year. Finally inFebruary, 1845, the President withdrew the name ofMr. Walworth and substituted that of Samuel of the Supreme Court of New York, whowas confirmed.
