Arnold Ringier returned February 26 from a fly- ing southwestern trip to visit the jobbers. DISCLAIMEIt AGAIN UPHELD. Another suit in which the disclaimer was the defense has been decided in the Circuit court of Jefferson county, Kentucky, in favor of Wood, Stubbs & Co., of Louisville, Ky. Thomas Wal- lace, a newspaper man and the owner of a farm in Jefferson and Oldham counties, claimed damages of $ because he was g^ven a garden variety of corn when he wanted field corn. Mr. Wallace said he is not an experienced farmer, and went to Wood, Stubbs & Co* last May and asked for seed for field corn. He purchased and paid for seed of Boone County White, which is the defendant's leading variety of field corn. The plaintiff charged that the corn was not Boone County White, but a garden variety, which produced a smaller crop than that which he would have obtained had the variety been Boone County White. His crop was worth, he stated, only $, whereas a crop of the field variety specified would have been worth $760, and he sued for the difference, $ In this particular instance, the cus- tomer dealt directly in person at the company's store, without having con- sulted a catalogue, so that in the store was the only place where the dis- claimer could have been brought to his notice.
