Shumaker and N. F. Stambaugh, com- plainants, and the Floral Nurseries, Inc., whose property is located at New Kingston, Pa., near here. Following the filing of the bill, the court appointed O. P. Gipple receiver for the company. The complainants are stockholders in the firm and also claim to be creditors. The bill states that the company is in- debted on obligations for the amount of approximately $5,000, on liabilities of about $9,800, and on open accounts of about $10,000. According to the bill, suits and legal processes for the collec- tion of the indebtedness have been in- stituted and threatened, and the cor- poration is without funds in hand to pay obligations or to raise additional capital. The company was incorporated a year ago under the laws of Delaware, and was authorized to issue preferred stock to the amount of $175,000, and 2,500 shares of common stock without par value. A iiumber of buildings have been erected on the property, and in- dications are that the company had a fairly good volume of business last spring. Statements have been made to the effect that orders are now being re- ceived and contracts executed at a profit. The corporation desires to continue the business; for that reason the appoint- ment of the receiver was requested. E. L. E. AMERICAN BOSE SOCIETY. Registration. In reference to the rose, Eureka, reg- istered by the American Rose Society under date of July 22, 1922: Objection to this name has been filed with the American Rose Society on ac- count of this name having been used by Hobbies, Ltd., of England, in 1914. This registration is therefore tempo- rarily withdrawn, pending the renaming of the rose. John C. Wister, See'y. Durham, N. C—C. N.
